- Patent Search: Motif provides a variety of patent searches that can save our clients time and money. Although we are confident that our clients have a better sense of their business and legal options after receiving the results of our searches, we believe our searches do not replace an opinion provided by capable legal counsel. We enjoy working with legal counsel to protect their patent portfolios at the most cost effective price. Our patent search services include:
- Novelty/Patentability: Determines if a newly conceived invention is different from patent and non-patent prior art. The results help identify potential issues that may arise during examination and help determine limits of possible patent protection.
- Accelerated Examination Search Document (AESD): Extends the novelty/patentability search. The results are prepared according to the USPTO guidelines for the accelerated examination (AE) program.
- Validity: Locates prior art and determines if it invalidates an in-force patent. We do this by locating patent and non-patent prior art published before the filing date of the in-force patent. The results are useful for enforcement readiness, legal defense purposes and justifying licensing royalties.
- Infringement: Locates patents, applications, products and services that are developed after the grant date of an in-force patent and that have features that map on to the claims of such in-force patent. The results are used to identify potential infringers and licensee opportunities.
- Freedom-to-operate: Determines if a given product or process has “clearance” and does not infringe upon any in-force patent claims. The results are needed when an organization wants to avoid alleged infringement when making, using, or selling a product or process.
- Patent Analytics: Our patent analytics services provide research and analysis to support our clients’ product/market strategic planning and include:
- Landscape analysis: Identifies trends, white spaces and gaps in order to align the business strategy of our clients with investment opportunities and threats. This analysis can also be performed on our client’s competitors.
- Portfolio analysis: Helps clients organize, classify and analyze their IP portfolio in order to determine the strength and sustainability of their market position. This analysis can also be performed on our client’s competitors.
- Claims mapping/overlap analysis: Maps the features of a new product onto the claims of related patents to determine if the product is covered by the company’s own existing patents or infringes on competitors’ patents.
- Proofreading: Motif’s proofreading services give you confidence that there are no errors or discrepancies in patents before filing patent applications or publishing granted patents. Clients use our proofreading services to ensure that their patent’s core claims are not weak during or after the application process.
